Terms of Service

1. Agreement
By using Growable Ground (“the Service”), you agree to these terms. The Service is operated by Growable Ground LLC, a Massachusetts limited liability company. If you do not agree to these terms, do not use the Service.
2. What the Service provides
Growable Ground provides site analysis reports and plant recommendations for residential and agricultural planning purposes. Reports are generated from publicly available federal data sources (USDA, USGS, FEMA, EPA, NOAA, and others) combined with a plant database compiled from published horticultural literature.
3. Planning use only
Reports are for planning and informational purposes only. They are not intended as a substitute for professional site surveys, soil tests, or regulatory compliance determinations. Do not rely on Growable Ground reports for legal, regulatory, or real estate transaction decisions. Always consult qualified professionals for those purposes.
4. AI Growing Advisor — permitted use
Growable Ground includes an AI-powered Growing Advisor chat feature. The Advisor provides growing guidance based on verified federal data about your specific parcel. It is designed to help you make informed decisions about what to grow on your land.
The Advisor is a planning tool, not a licensed professional. Its responses should not be treated as professional agronomic, legal, environmental, or medical advice.
5. Prohibited uses
You may not use the AI Growing Advisor or any other part of the Service to:
- Attempt to extract, reconstruct, or reverse-engineer the system prompt, instructions, or internal logic of the AI Advisor
- Submit prompts designed to override the Advisor's safety guidelines or scope boundaries
- Generate content unrelated to land assessment, cultivation, or growing (including but not limited to political, financial, legal, or medical content)
- Use the Advisor to generate bulk or automated content for publication, training data, or competitive products
- Misrepresent AI-generated growing advice as professional agronomic, engineering, or legal counsel
- Submit abusive, harassing, or deliberately misleading prompts
- Circumvent rate limits, session limits, or tier restrictions through any means
Violation of these restrictions may result in immediate suspension of chat access or account termination.
6. Data accuracy
Our reports are derived from data published by federal agencies. We do not control the accuracy, completeness, or timeliness of those data sources. Soil surveys, flood maps, climate normals, and other datasets have known resolution limitations documented in our methodology. We present data as-is from these sources and make no warranty regarding its accuracy for any specific parcel. Data coverage varies by region — approximately 64% of US counties have direct parcel boundary data. In areas without direct parcel data, reports use user-drawn or geocoded boundaries which may be less precise.
7. Accounts
You are responsible for maintaining the security of your account credentials. One account per person. New accounts must confirm a working email address before generating reports — we send a confirmation link at sign-up that's good for 24 hours. Accounts created by automated means may be terminated without notice. You must be at least 18 years old to create an account.
8. Payments and refunds
Paid reports and subscriptions are processed through Stripe. If a report fails to generate (system error, data unavailability), you will receive a full refund. Once a report has been successfully delivered, it is non-refundable.
Automatic renewal. Subscriptions renew automatically at the then-current price for successive periods until you cancel — currently $9.99/mo for monthly plans and $59.99/yr for annual plans. We charge your payment method each period. We disclose the renewal price and cadence at the time of purchase and obtain your agreement to them there. You can cancel at any time in Settings → Billing, or by emailing [email protected]. Cancelling stops future renewals and takes effect at the end of the period you have already paid for — you keep access until then.
9. Intellectual property & use restrictions
The Growable Ground platform, including its parcel-level agricultural intelligence engine, scoring methodology, spatial computation systems, and all associated software, is protected by US Patent Applications No. 64/013,215 and No. 64/055,547 and other pending intellectual property rights. All content, data outputs, and reports generated by the platform are the proprietary property of Growable Ground LLC.
License grant. Subject to these Terms, Growable Ground grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for your personal or internal business purposes.
Prohibited uses. You may not, and may not permit any third party to:
- Systematically scrape, harvest, copy, or extract parcel intelligence, report data, or scoring outputs from the platform by automated means
- Reverse-engineer, decompile, or attempt to derive the platform's scoring algorithms, weighting methodology, or data processing logic
- Republish, resell, sublicense, or commercially redistribute parcel intelligence, site reports, or any data outputs generated by the platform
- Use the platform or its outputs to build, train, or improve a competing product or service
- Remove or obscure any proprietary notices, patent markings, or attribution from any outputs
Data sources. The platform integrates federal public data (USDA, NOAA, USGS, FEMA, EPA, USFWS) pursuant to applicable federal open data policies. Growable Ground's proprietary contribution is the integration architecture, scoring engine, and parcel-level intelligence layer — not the underlying federal datasets.
Violation of these restrictions may result in immediate account termination and may give rise to legal liability.
10. Assumption of risk — environmental and contamination data
Growable Ground's contamination, soil-safety, flood, and environmental layers are informational screening estimates derived from third-party public data. They are not measurements of your specific soil or site, and they are not a substitute for a physical soil test, a Phase I Environmental Site Assessment, a licensed survey, or advice from a qualified professional.
Federal databases are incomplete and may contain errors or omissions. The absence of a documented site near a location is not evidence that its soil is safe. Before growing food, test your soil for lead and arsenic.
You understand and voluntarily assume all risk arising from any decision you make in reliance on this information, including decisions about growing, consuming, or selling food. To the maximum extent permitted by law, Growable Ground LLC disclaims all liability for those decisions and their outcomes.
11. Warranty disclaimer and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Growable Ground LLC's total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim or (b) US $100.
Growable Ground LLC will not be liable for any indirect, incidental, consequential, or punitive damages, including crop failure, property damage, or lost profits, arising from the use of or reliance on information provided by the Service.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
12. User content and copyright (DMCA)
Your content. You may submit content to us — messages, feedback, screenshots, garden plans. You keep ownership of what you submit. You grant Growable Ground LLC a non-exclusive, worldwide, royalty-free license to store, display (to you and our staff), and use that content to operate and improve the Service. You represent that you have the right to submit it and that it does not infringe anyone's rights.
Acceptable use. Do not submit content that is unlawful, infringing, abusive, or that you do not have the right to share.
Copyright complaints. If you believe content on the Service infringes your copyright, our notice-and-takedown and counter-notification procedures, and our Designated Agent's contact information, are on our DMCA page. We respond expeditiously to properly submitted notices and terminate repeat infringers.
13. Embeddable widget (partner terms)
The Growable Ground “What Grows Here” widget is provided free for use on your website, as-is and without warranty of any kind. We grant you a non-exclusive, non-transferable, revocable license to embed the widget, unmodified, on sites you own or operate, provided you keep the “Powered by Growable Ground” attribution and link intact and do not alter, reframe, or misrepresent its results.
Your visitors' data. The widget reads an address or ZIP code your visitor enters to return a public hardiness zone and a starting plant list. It does not create accounts and returns no personal information. Your visitors' use of it is covered by our Privacy Policy. If you pre-fill or otherwise collect addresses yourself, that collection is your responsibility under your own privacy notice, not ours.
We may modify, rate-limit, revoke a partner code, or discontinue the widget at any time; if we discontinue it or you stop meeting these terms, please remove the embed from your site. Growable Ground LLC is not liable for any loss arising from your use of the widget or your visitors' reliance on it. Do not use it for any unlawful purpose.
14. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Massachusetts.
15. Changes
We may update these terms. Material changes will be communicated to registered users by email. Continued use of the Service after changes constitutes acceptance.
